Terms of Service — Fahmix AI Trust

1. The service

Fahmix AI provides a multi-tenant AI customer-support and sales platform via web dashboard, API, and embeddable widget. By creating a tenant you agree to these terms.

2. Billing — Resolved Outcome Units

You pay per Resolved Outcome Unit. A ROU is minted when a conversation clears the following gates:

At least 2 conversational turns
Confidence ≥ 0.6 on the last classifying turn
24 hours pass without a new inbound message (assumed-resolved)
The 72-hour reopen window passes without a new inbound message
The 7-day CSAT window does not register a score ≤ 2

Reopens inside 72 hours or CSAT ≤ 2 inside 7 days produce an automatic clawback credit. Disputes can be raised against any ROU and are resolved within 7 business days.

3. Acceptable use

You may not use Fahmix AI to:

Process Personal Data of minors without verifiable parental consent
Generate content prohibited by the Llama Guard 3 safety taxonomy
Attempt to extract system prompts, model weights, or internal infrastructure
Spam end-users or violate TCPA / TPS / DNC / CAN-SPAM regulations

Violations may result in account suspension. Compliance violations (Article 50 disclosure disabled for EU end-users; Article 26 audit-tampering attempt) are zero-tolerance.

4. Service level

SMB tier: best-effort, no contractual uptime. Growth tier: 99.5%. Enterprise tier: 99.9% per Region with documented SLA credits per missed month. Schedule + credit % set in /dashboard/billing/sla.

5. Intellectual property

Customer retains all rights to Customer Data and any prompts, personas, KB documents, or workflows uploaded. SayShan Technologies retains rights to the Fahmix AI platform, underlying models routing, and aggregate platform telemetry.

6. Disclaimers

Fahmix AI uses statistical AI models. Outputs may be inaccurate. Customer is responsible for monitoring and validating model outputs. SayShan Technologies disclaims warranties of merchantability and fitness for a particular purpose to the maximum extent permitted by law.

7. Limitation of liability

To the maximum extent permitted by law, total aggregate liability is limited to the greater of (a) USD 5,000 or (b) fees paid in the preceding 12 months.

8. Governing law

These terms are governed by the laws of Singapore for tenants with homeRegion=apac, Ireland for homeRegion=eu, and Delaware for homeRegion=us. Disputes are resolved in the corresponding seat.
